Pengerusi kuil bebas tuduhan ceroboh tanah persendirian di Dengkil

The High Court in Shah Alam has dismissed charges against M Paramaguru M for allegedly trespassing on private land in Dengkil, Sepang last year. Lawyer Latheefa Koya, representing the 49-year-old M Paramaguru, stated that Judge Hazlina Hussain made the decision after overturning the charges presented by her son. The case was discussed during a hearing with Bernama following the proceedings.

Deputy Prosecutor Mohd Heikal Ismail also attended the hearing. Latheefa informed that Judge Hazlina, while making the decision, clarified that the charges failed to prove that Paramaguru had the necessary intent to commit the offense. She added that if the case had proceeded to a full trial, it would have wasted court time due to the defectiveness of the charges.

The paramaguru had filed the application on March 25 last year, citing that the charges against him were flawed and could not be continued because they failed to state and illustrate the crucial element of mens rea, specifically the intent to commit an offense by entering the land with the intention to commit, insult, or disturb the person possessing the property.

According to the application, although the offense was committed under Section 447 of the Penal Code, it did not prove any offense known to the law. Paramaguru, who was also a safety officer previously, admitted not being guilty of trespassing into Suhaili Ahmad's land, aged 71, without permission, located at Jalan Selangor, Dredging, Dengkil at 4.45 pm on June 19, 2025.

The charges were brought under Section 447 of the Penal Code, carrying a maximum penalty of six months in jail or a fine of up to RM3,000 or both, if found guilty of the offense.
